Food Safety Supervisor Requirements by State — What You Need to Know

Food safety laws vary by state and territory across Australia, but the national Standard 3.2.2A sets the baseline: since 8 December 2023, category 1 and category 2 food businesses — those handling unpackaged, potentially hazardous, ready-to-eat food — must appoint a certified Food Safety Supervisor who is reasonably available. That covers cafés, restaurants, takeaways, bakeries, caterers, pubs and many food retailers in every state and territory. The FSS must hold a nationally recognised qualification — specifically SITXFSA005 and SITXFSA006 — issued by a Registered Training Organisation. Non-compliance can mean fines and enforcement action at inspection.

Where the states genuinely differ is renewal, and this is the detail most businesses get wrong. The units themselves carry no printed expiry date. But NSW, Queensland, Western Australia, South Australia, Tasmania and the ACT all require your FSS training to have been completed within the last five years — so in practice you redo the course every five years. Victoria is the main exception and sets no renewal period, and the Northern Territory publishes none.
